Biography
Danny Fuchs is a partner at Manion Stigger having dedicated his professional life to supporting general contractors, specialty subcontractors, owners, suppliers, and design professionals in the construction of power generation plants, manufacturing facilities, paper mills, food processing plants, and buildings for governments, healthcare, hospitality, commercial, and multifamily uses across the country. Danny was educated as a civil engineer, worked for a heavy civil contractor, and leans heavily on his years of experience in project management to provide practical advice and meaningful analysis.
Danny has drafted and negotiated contracts for project delivery through design-bid-build, design-build, EPC agreements, construction management at-risk and as-advisor, and fast-track construction methods. He has successfully resolved disputes involving scheduling problems, acceleration, delays, productivity impact, defective construction, defective design, contractor termination, and bond claims through litigation, arbitration, and mediation.
Danny’s clients regularly look to him to minimize enterprise risks through operational counsel and advice while managing issues in real-time to avoid disputes and deliver a successful project outcome. Danny’s experiences – both in the field and in his legal practice – provide him with the unique ability to address legal issues on a project site with practical considerations in mind.
Danny regularly presents to lawyers and contractors alike on matters relating to managing construction risk and has been recognized by Super Lawyers for his work in Construction Litigation as an acknowledgment of his efforts.
Representative Experience
Counseled specialty subcontractor on impacts and recovery of claims experienced on multiple federal projects and pursuit of Miller Act bond claims.
Recovered subcontractor delay and impact costs and defended against counterclaims to recover contract balance on 755-MW combined-cycle power generation project through arbitration.
Advised county government on completion of new judicial center through termination of non-performing contractor and resolution of disputes.
Recovered additional costs incurred by contractor for extra-contractual scope work performed on petrochemical facility.
Recovered payment for subcontractors from project owners through mechanic’s lien foreclosure action where general contractor was insolvent.
Negotiated $73 million design-build contract for the construction of a healthcare facility.
Drafted family of construction contracts for national healthcare provider for facilities nationwide.
Represented specialty subcontractor in claims of over $10 million due to contractor’s active interference and defenses to default under subcontract.
