Biography
Andrew John “A.J.” Manion is a Co-Founder of Manion Stigger, LLP. A.J.’s entire career has centered around construction: working as a laborer during high school; engineering education; construction project manager after college; and, for the last 30 years, attorney representing general contractors, construction managers, design-builders, and subcontractors throughout the United States.
A.J.’s goal is effective representation. A.J.’s time in construction, MBA after law school, and three decades representing leading contractors bring a deep understanding of potential solutions and strategies. Adding to his engineering and business background, A.J. is a skilled trial attorney with successful experiences in jury trials, court trials, arbitrations, and appeals, having prosecuted and defended substantial claims in a variety of construction contexts.
While always ready to litigate or arbitrate, A.J. has especially enjoyed proactively working with clients to develop processes and controls to prevent disputes in the first place. He accomplishes this through learning clients’ business models and corresponding challenges and then working with a broader team to develop and implement project management systems that proactively protect their businesses from risk.
A.J. frequently lectures on topics in the construction industry and dedicates significant time to sharing knowledge with construction industry trade groups. Representative Experience
Prosecuted multimillion-dollar delay/disruption/productivity claims against state governments, power plants, industrial facilities, and commercial developments.
Conducted in-house risk analysis and training programs for general contractor, construction manager, design-builder, and specialty contractor clients.
Prosecuted design defect claims and differing site condition claims in various jurisdictions involving state government, local government, and industrial and commercial projects.
Defended construction defect claims in various jurisdictions involving state government, local government, and industrial and commercial projects.
Drafted and negotiated dozens of design-build agreements for multimillion-dollar medical facilities.
Drafted and negotiated engineering, procurement, and construction (EPC) agreements for material handling and other industrial facilities.
Negotiated joint-venture agreements between diverse contractors for public, private and public-private partnership projects.
Prosecuted bid protests on public projects in various jurisdictions, including a plaintiff group of competing contractors in protesting illegal schemes attempting to evade public bidding statutes through the state Supreme Court.
Represented contractors in OSHA proceedings in various jurisdictions including more than a dozen cases involving job-site fatalities.
